A WORCESTER woman who falsely claimed to be an osteopath has seen her appeal rejected.

Michelle Davies, 48, was found guilty of wrongly describing herself as an osteopath when she was not registered as such.

Davies had been suspended from the Register on an interim basis until the conclusion of her fitness to practise case and was therefore not permitted to use the title.

She appealed the guilty verdict, made during a private prosecution trial at Kidderminster Magistrates Court on October 3, but has now seen her appeal against her conviction dismissed by Crown Court.

As such, she will still have to pay an £800 fine and has also been ordered to pay prosecution costs of £1,728.

Using the osteopathic title while suspended from the Register is contrary to section 32(1) of the Osteopaths Act 1993.

Since the passing of this act, the osteopathic title is protected, which means it is a criminal offence for any person to describe themselves as, or to imply that they are, any kind of osteopath unless they are registered with the General Osteopathic Council.

Davies, who practices out of English Mutual House on The Tything, continued to use the title on her website, www.worcester-osteo.com.

The website, which seemingly hasn’t been updated since the appeal was dismissed, reads: “Michelle entered a plea of no jurisdiction and no liability on the grounds of fraudulent breach of natural justice +human rights + overriding justice objective with an application for case dismissal and contempt remedies. 

“The District Judge and Circuit Judge dismissed Michelle's plea of NO JURISDICTION and found guilty and charged a fine.

“Michelle will continue with the appeal process and expose the fraud and corruption.

“To date, Michelle's case exposes criminal conspiracy proof against the State, Professional Authorities and Law Courts!!”

Her appeal was considered at Worcester Crown Court on March 17 of this year.

According to the Companies House website Davies' company, Osteopathy & Natural Therapy Centre, has overdue accounts as well as a confirmation statement overdue.

Companies House also states there is an "active proposal to strike off" the business.
