A DRIVER stopped by police on a Kidderminster estate was more than three times the limit for driving, an appeal heard.
Rimantas Maciulevicious was jailed for four months when he appeared before Kidderminster magistrates last month.
But he successfully appealed against the sentence at Worcester Crown Court and it was reduced to two months.
This meant his immediate freedom as he had already served more than five weeks. The two-year disqualification stands.
Maciulevicious, 31, of Wellesbourne Road, Handsworth Wood, Birmingham, was seen at the wheel of a van in Upton Road and Sion Avenue on the Broadwaters estate on May 1.
His breath-alcohol reading was 114 microgrammes in 100 millilitres, said Michael Conry, prosecuting. The limit is 35.
Defence counsel Dele Alakija said Maciulevicious - who listened to the case through a Russian interpreter - had been on a two-day "bender" and did not realise he would still be over the limit.
Judge Bruce Coles reduced the jail term based on sentencing guidelines for a guilty plea.
