A WYCHBOLD care home for adults with learning difficulties has successfully opposed a compensation claim by a former support worker who alleged the management's attitude caused her to leave the job.

Sian Baggus, of Bromsgrove, made a compensation claim for constructive dismissal at Birmingham Employment Tribunal against The Hawthorns care home, which is run by Yunicorn Ltd.

Miss Baggus complained about being given the 'cold shoulder' by her senior manager while taking the adults with learning difficulties on a holiday to the Isle of Wight.

The tribunal was told Miss Baggus was also involved in a dispute over a trip to a Butlin's holiday centre.

On one occasion she complained she was told to do an extra evening's training following an exhaustive 12-day shift.

She also complained about a lack of support and a lack of equal opportunities in the home.

The tribunal was told that Miss Baggus alleged there was animosity in the home and that "everyone was trying to compete against each other."

The management denied the allegations, however, and said they had tried to persuade Miss Baggus to stay on after she announced she was leaving.

Tribunal chairman John Parkin said there had obviously been personality clashes, but the tribunal found there had been no lack of support for Miss Baggus.

He also pointed out that on one occasion Miss Baggus resigned and later returned to her job at the home.

She had written a strong letter of grievance last June about difficulties in carrying out her working role, but Miss Baggus had not proved to the tribunal that she was constructively dismissed, said Mr Parkin.

"As a result the tribunals decision is that the claim for constructive dismissal is rejected," he said.

The home was said to have nine staff.
