An Upton town councillor is appealing against an enforcement order for breaking planning rules.
Tim Perry, deputy chairman of the town council's planning committee, has been ordered to remove a 12ft high garage which he built in his garden without planning permission.
Coun Perry was refused retrospective planning permission in December 2003, after he had built the structure earlier in the year. He lives in New Street, which is in the town's conservation area.
When he initially appealed against the decision in September 2004, an inspector decided the garage spoiled the character of the area.
The enforcement order, which gives two months for the offending structure to be removed, was issued on Monday, September 5.
The garage still stands at present because Mr Perry is appealing against the order.
