A REDDITCH former warehouse worker who was sacked after allegedly screwing up a customer's order list and throwing it away following a dispute has lost a compensation claim for unfair dismissal.

Stephen Davis, of Kineton Close, Matchborough, made his claim at a Birmingham employment tribunal against Maria Tubes Fittings Ltd of Alcester.

The tribunal was told Mr Davis had been employed by the firm for just over two years in the distribution warehouse.

It was alleged he had been involved in one or two disputes with the firm and had been given a final warning letter.

The tribunal was told that following another dispute, Mr Davis was alleged to have screwed up a customer's order list and to have thrown it away, causing the management problems.

Mr Davis was sent a letter by the firm in the December telling him he was being dismissed but that he had a right to appeal.

Mr Davis denied screwing up the list and throwing it away. He said he believed he had been treated unfairly.

Tribunal chairman Roger Balmain said it was not the tribunal's responsibility to decide whether or not Mr Davis had destroyed the list.

"This is not a criminal court - our duty is to decide whether the firm acted in a reasonable and responsible manner in dismissing Mr Davis in view of their investigations into the alleged incident," he said.

"Although the firm's disciplinary hearing involving Mr Davis was adjourned and witnesses further interviewed, the tribunal panel believes the disciplinary procedure was carried out in a fair manner.

"Mr Davis had previously been given a final warning and he failed to appeal against the disciplinary hearing's decision.

"As a result, Mr Davis' compensation claim for unfair dismissal is rejected."

Mr Davis said after the hearing he had now got another job.
