CHARGES against a Worcester man have been dismissed after a vital witness failed to turn up at court.
Evesham magistrates yesterday dismissed charges of assault brought against Mark Richards.
The 24-year-old, of Gorse Hill Road, Brickfields, also faced a charge of damaging a set of false teeth on September 14 last year.
George Shone, prosecuting, told magistrates the reason his essential witness was not present was that notice of requirement at the trial had been sent to the wrong address and he had never received it.
"I've telephoned him, but he's at work making deliveries in Birmingham and unable to get here today," said Mr Shone.
David Taylor, for Richards, who denied both charges, asked magistrates to rule it was not in the interests of justice to allow another adjournment in view of the fact the trial had previously been adjourned because another witness was unable to attend.
