Harriers were reduced to 10 men near the half-hour mark after a fracas next to the Chesterfield bench.
A number of players from both sides got involved after Foster battled for possession near the side line with defender Booty who was on the floor.
Referee Leake ruled Foster had taken a kick at the defender while he was on the ground and the striker's actions led to home manager Laws becoming involved in the melee.
When order was restored, Foster was sent off and Booty booked.
