A LATE-night reveller was told he would have his "teeth kicked down his throat" in a vicious attack outside an Evesham club.

Worcester magistrates heard how Anthony Rusher made the threat to Stephen Middleton outside Marilyns nightclub, before pushing him down the stairs and kicking him in the face.

Twenty-three-year-old Rusher from Coronation Street, Evesham, admitted he had assaulted Mr Middleton in the early hours of Saturday, June 8, but said it was because he had been "in his face" inside the club.

John Barnett, prosecuting, said Mr Middleton had been out drinking since around 7pm and by the end of the evening had consumed around seven pints of lager.

At 2.30am he was asked to leave the club, in The Crown Courtyard, Bridge Street, because he was too drunk.

While milling around outside he went up the stairs of the club to talk to his sister, when he saw Rusher and his attacker began his verbal assault.

"(Rusher said), I am going to kick your teeth down your throat if you don't get out of my face," said Mr Barnett.

"He (Mr Middleton) turned round and felt a push to the back of his head and he landed face down.

"He had small scratches on his hands and his trousers were ripped. He looked up and he saw Rusher, who then kicked him in the face."

Mr Middleton ran to a nearby police officer who advised him to go to casualty. He was left with a thick and split lip as well as the grazes.

Chris Hilton, defending, said Mr Middleton had drunk considerable amounts of alcohol and had gone round groups of people, including a group with Rusher, looking to start a fight in the club.

He said Rusher had left the club an hour later, not expecting Mr Middleton to be there, and he lost his temper.

"He (Rusher) was upset that he could have been barred from the nightclub and he was still upset at that," said Mr Hilton.

"The person was in his face but he appreciates his actions were not acceptable."

Magistrates ordered a pre-sentence report for Friday, August 23, and Rusher was placed on unconditional bail.
