MAN has appeared in court charged with assault and breaching an anti-social behaviour order.
Dick Dawe, aged 68, appeared before Worcester magistrates yesterday. He denies both charges.
The case was adjourned because David Taylor, defending, said there was no written proof the anti-social behaviour order had been imposed.
The order was made for 15 years at Droitwich Magistrates Court in March 2000, but was later reduced on appeal to five years at Hereford Crown Court.
However, Mr Taylor said there was no official document to back the appeal decision up.
"If he's not the subject of a properly, lawfully made order, he can't be guilty of breaching it," he said.
Dawe, of Hollybed Street, Castlemorton, is accused of breaching the order by assaulting a neighbour on Friday, March 29, this year.
The magistrates agreed to adjourn the case until Friday, September 6.
