A RESTRAINING order has been made against a man who harassed a city bar manager and assaulted a train conductor.

David Pace was also ordered to pay £100 compensation each to Donna McDonald, of the Royal Exchange Pub, Worcester, and to the conductor from Central Trains.

Worcester magistrates had heard at a previous hearing that Pace had prodded the female conductor in the groin as she issued a non-payment ticket to him.

He had also been found guilty of disorderly behaviour following a subsequent incident on a train after it left Worcester Foregate Street on its way to Hereford.

"She saw the defendant walking towards her as she was standing in the aisle," said Mary Wallace, prosecuting.

"She leant forward so as not to be in his way but he pretended to trip over her.

"He laughed and verbally abused her for several minutes."

Pace, of Avon Road, Tolladine, also admitted harassing Ms McDonald, assistant manager at the Royal Exchange in the Cornmarket.

Over several months, culminating in his arrest in September 2002, Pace had verbally abused Ms McDonald.

On two occasions he had dropped his trousers and exposed himself to her and the public.

"She said he was a persistent problem, particularly when the pub was busy," said Miss Wallace.

"She said she was getting quite upset."

The court heard Pace had a history of offending over the years.

"For a man of 38 his life has been full of incident and problem," said Barry Newton, defending.

"He has a fairly long offending history. As he grows up, the nature of offending changes. He's a shadow of his former self. In December 2001 he was violently stabbed and was clinically dead at one point.

"It's no wonder that he's still suffering from that attack. He remains fearful because of what happened to him."

Pace was sentenced to a three-year community rehabilitation order. He was fined £50 for a bail act offence and ordered to pay £260 costs.

He was also ordered to pay £100 to each of his victims. Magistrates also imposed a restraining order for an indefinite period of time preventing him from harassing or contacting Ms McDonald. He's also not allowed to go within 90ft of the pub where she works.
