A STATEMENT issued by Worcestershire Acute Hospitals NHS Trust confirmed Mrs Shurmer had brought a clinical negligence claim against them in respect of antenatal care provided in February, 2001.
It said the trust had accepted responsibility for the claim, provided a formal letter of apology and paid the family an agreed sum of compensation and their legal costs.
"The trust sincerely regrets the events that gave rise to the claim and sends its sympathy and best wishes to the family."
Spokesman, Richard Haynes, added the hospitals trust, Wyre Forest Primary Care Trust and West Midland South Strategic Health Authority shared Mrs Shurmer's view that the facility should not reopen unless all the recommendations of the report had been implemented and "the safest possible service" was being provided. A panel set up to monitor the implementations of the inquiry will report its findings to the strategic health authority next month.
