ALFRED W Smart, Grange Street, was summoned for having no control over a horse and cart in Peakman Street, on March 28th.
Pc Bonnel gave evidence.
Defendant pleaded not guilty and said he paid a man to stand by the horse while he made a call for an order for some coal.
The police constable stated no one was standing at the horse's head from 20 minutes past four until 20 minutes to five, when defendant came on the scene.
Defendant persisted in his statement and was corroborated by James Mills, who said he was standing at the horse's head when the policeman appeared.
Defendant was given the benefit of the doubt and the case was dismissed.
