A disc jockey has denied raping an 18-year-old girl during last year's Upton Water Festival.

David Benson, aged 55, told a jury that everything that happened during their sexual encounter was with her consent.

He pleaded not guilty to rape, two counts of assault by penetration and sexual assault on August 28 last year.

Worcester Crown Court heard that Benson ran a disco at The Talbot pub before inviting a number of people back to his nearby home for a late party.

The teenage girl, who had drunk eight bottles of beer and two alcopops, collapsed in the bathroom and was put to bed to sleep it off.

Benson, now of Sansome Street, Worcester, reassured her brother that she could stay the night to recover and he would wake her in time for work.

The girl described how she came to be lying on a bed partly naked with Benson on top of her.

"I started to fall in and out of consciousness," she said. "I was saying no in my mind but not actually saying it."

She said she then left the house for a friend's flat, injuring herself during the walk.

The friend, who called the police, told the jury he likened her state to someone who had suffered bereavement.

He said: "She was stressed and shaking. She was completely dishevelled and had been crying. I just knew something bad had happened."

Francis Laird, defending, accused the girl of performing a sex on Benson.

Benson, who said he had drunk 12 to 14 pints and was incapable of having full sex, claimed the girl showed no signs of distress.

He said they ended the night with a kiss and a cuddle and maintained she had enjoyed their encounter. Benson denied a suggestion by prosecutor Mark Wall that the girl was comatose through drink and unable to fight him off.

The jury had retired to consider its verdict at the time of going to press and the judge indicated he was willing accept a majority decision.
