THOMAS Tolley, Alcester Street, pleaded not guilty to being drunk in Swan Street, Alvechurch, on June 13th.
Pc Bennett said about 9pm he saw defendant, who was very drunk, being lead along the road by another man.
When this man left him, defendant was so drunk that he could scarcely walk and eventually had to lean over some railings for about an hour to recover from the effects of the drink.
Defendant said he was subject to fits and had a fit come on.
The police constable, however, denied defendant was in a fit on this occasion.
Defendant was the worst for drink at four o'clock in the afternoon and he told him to get off to Redditch.
Pc Garrard corroborated as to defendant's drunken condition.
Defendant again emphatically denied being drunk and said he could call two or three witnesses to support his statement if the case was adjourned.
All the drink he had that day was two half pints of ale.
The Bench adjourned the case for a week to enable the defendant to call witnesses.
