A 30-YEAR-old man once warned by a Worcester judge he could expect to be jailed if he committed another offence, has escaped jail again. 

We reported Ashleigh Booth was sentenced in July 2022 for his role in a vicious attack when he punched his uncle several times in the face.

Judge Martin Jackson gave Booth a 12-month jail suspended for two years. 

Booth, of Derby Road, Worcester, and previously of Evesham and Broadway, returned to Worcester Crown Court, on Thursday, (December 7). 

Judge Jackson heard Booth had breached his suspended sentence but decided against activating it.

Instead, he fined Booth £50 for the breach and told him to pay £60 cost - a total of £110 which the judge ordered he pay in full in 28 days.

In the original case, the court heard Booth had gone to the Evesham home of his uncle Tony Gurney.

On arrival, the victim told Booth and the others with him they were not allowed inside the home.

“He (Mr Gurney) put his arm across the doorway,” Jas Dhaliwal prosecuting said.

“The defendant then punched Mr Gurney in the face, five or six times.”

Mr Dhaliwal said the victim had, at first, thought Booth was wearing a knuckleduster but it later emerged Booth was wearing a ring on his finger.

The prosecutor added an aggravating feature was Booth’s seven previous convictions, including being jailed for common assault in 2016.

As well as the suspended jail sentence Booth also placed him on a four-month curfew and ordered him to complete 20 rehabilitation activity days.
