A 37-YEAR-OLD man who admits driving while disqualified but denies using a mobile phone at the time has had his trial delayed further. 

Matthew Heaton previously admitted driving a Mercedes on the Alcester Bypass in Arrow, near Alcester, on January 12 this year when he was banned from getting behind the wheel.

Heaton, of Lark Hill, Worcester, appeared at Worcester Magistrates Court on July 31 expecting to have his trial for a further charge he denies of using a handheld mobile phone while driving a motor vehicle.

But magistrates told Heaton that his trial would be adjourned. 

Heaton was told to return to the court on the afternoon of October 27, when his expected three-hour trial will now take place. 

The defendant was given unconditional bail and has been warned, if he fails to attend his trial, he risks it going ahead in his absence.
