A 30-YEAR-old man who told magistrates he goes to the gym five times a week said he was medically unfit to do unpaid work. 

Dene Davies was finally sentenced at Worcester Magistrates Court on Tuesday, (August 8). 

He was previously remanded into custody after failing to speak to probation for a report ahead of his and the defendant.

Davies, of Cranham Drive, Worcester, previously admitted two offences of assault by beating of an emergency worker, arson, criminal damage to property and a public order offence.

Davies had also failed to comply with the requirements of a community order and failed to turn up at Worcester Magistrates Court for an earlier hearing.

Lauren Millichip, prosecuting, explained the first offence took place on May 4 last year when the defendant had been at a former partner's house in Worcester. 

Davies had come downstairs calling the victim names, punched a hole in the wall before leaving the property with the victim locking the door behind him. 

After screaming outside Davies kicked a panel of a door at the victim's property damaging it. 

The prosecutor said the victim had been very distressed.

On May 28, Davies returned at 3.15am waking her up by repeatedly pressing her doorbell.

Davies again abused the victim this time in front of a neighbour who, concerned he would turn violent, called the police.

The court also heard at 1.30am on August 14 Davies had been at Cellar Bar, Foregate Street, when police were called. 

Miss Millichip said Davies refused to leave the area after being repeatedly being asked to leave leading to his arrest. 

Davies then kicked PC Ellis in the leg and PC Penney in the shin.  

Later, when he was in a police cell at the police station, Davies lit a pillow with a lighter he managed to smuggle in.

A probation service representative told the court Davies was given unpaid work for assaulting an emergency worker last year but had not completed any of the hours.

Davies, defending himself, said "he would never behave like that to a woman" and said he had a medical reason for not doing his unpaid work. 

Davies then said: "I'll do unpaid work, I go to the gym five times a week. 

"If it means me getting out of here (custody) I would go and do it."

After lengthy deliberations, chairman of the magistrates bench, Martin Soble, gave Davies an 18-month community order with 24 weeks curfew and 40 rehabilitation activity requirement days. 

When Davies asked if his curfew hours could be altered for a boxing class the chairman told him "sorry, no".

The defendant was told to pay a total of £682.86 compensation and given a two-year restraining order preventing contact with his former partner.
