THE trial of a 30-year-old man accused of ABH will not be held at Worcester Crown Court due to him previously having worked there as a security guard.
Luke Timms of The Elms Hotel, Stockton Road, Abberley and formerly of Woodhouse Close, Worcester, is accused of assault of a person thereby occasioning them actual bodily harm.
The prosecution alleges that on October 13 last year, in Worcester, Timms assaulted Daniel O'Donnell.
At the start of the latest hearing of Timms' case at Worcester Crown Court Jason Patel, defending, said the situation had been explained to the court in writing.
His Honour Judge Jonathan Salmon said, having read the papers on the matter, it would be "wholly inappropriate" for the case to be tried at the city court.

Judge Salmon added he would approach the relevant judges at Gloucester or Bristol for the case to be moved to either of those crown courts instead.
The judge apologised to Timms as it will cause a delay in his case and said the apology would also go to others involved in the case.
Timms, who has unconditional bail, thanked the judge as he left Courtroom 2 on Thursday, (April 20).
