A MAN spat and threw an Xbox console out his window at police, Worcester Magistrates Court heard. 

Simon Hilton barricaded himself in his flat in Worcester Road, Wychbold near Droitwich, after being told he would be arrested. 

Aleigha Adams, prosecuting, said police were called to the home of the 34-year-old on the evening of September 5 last year. 

"They tried to speak to the defendant," the prosecutor said.

"He refused to open the door. PC Garrety told him he would be arrested -  he said he would attack officers.

"The officer asked him to stop shouting so that a (police) dog would stop barking.

"He was aggressive and abusive."

Miss Adams said Hilton, at the window of the first floor flat, repeatedly spat at PC Garrety out the window. 

"He threw a full beer can out the window," the prosecutor said. 

"He threw a Yankee candle. 

"He then threw an Xbox console which smashed into pieces after hitting the ground."

Miss Adams said officers, who eventually got in and arrested the defendant, were not hit by the items she described as "weapon equivalents".

In interview, Hilton told police he was spitting out the window "because it is his window, he is allowed" and said he threw items as he thought it would make officers leave. 

She added Hilton had 67 offences on his record with previous convictions for public order and assaulting emergency workers.

Jo Outwaite defended Hilton who admitted common assault of an emergency worker and using threatening/abusive words/behaviour likely to cause harassment, alarm or distress.

Mr Outwaite explained Hilton had been in a long-running dispute with a neighbour who, she said, had made a number of malicious false allegations Hilton had been arrested for. 

She said Hilton knew police were going to arrest him for something he hadn't done, so acted out of frustration. 

"He reacted poorly," Miss Outwaite said. 

"He had got himself in a state. He accepts his actions were irresponsible and should not have happened."

Mrs Outwaite added things were looking positive for Hilton now as the neighbour was potentially being evicted, and Hilton's mental health had improved as he was no longer taking drugs.

Russell Williams, chairman of the magistrates bench, told Hilton he was being fined £180. 

Hilton was told to pay costs of £100 and victim surcharge of £48. 

The chairman wished Hilton good luck adding he hoped he could move on without his "annoying neighbour".

The case was heard at the court on Thursday (March 9).
