A DRINK and drug driver ran a red light before causing a crash, magistrates heard.
Jak Jagielski admitted charges of driving a motor vehicle when his alcohol level was above the limit, and with a proportion of a specified controlled drug above the specified limit, when he appeared at Worcester Magistrates Court on Thursday, (September 22).
Sumreen Afsar, prosecuting, said police were called to a crash in Saltway, Droitwich, at 11.50pm on March 6 this year.
The prosecutor said Jagielski told officers he had been drinking earlier that evening before driving a VW Golf, and going through a red traffic light causing the crash.
Jagielski failed a roadside breath test and was taken to the police station.
Mrs Afsar said officers had a problem with the machine at the station, that gives the evidential reading, so instead blood was taken.
That test would reveal Jagielski had 83 milligrammes of alcohol in 100 millilitres of blood - the legal limit being 80 milligrammes, and he had 61 micrograms of benzoylecgonine, a cocaine metabolite, per litre of blood - the legal limit being 50 micrograms.
Mrs Afsar added Jagielski had no previous convictions.
Gary Harper, defending, said his client was "terribly disappointed" to appear before the magistrates, saying he made miscalculations that night.
Mr Harper said Jagielski, 20, had been to a wedding and drunk prosecco, not working out the units he had consumed.
"He had no intention to drive, but his girlfriend asked for a lift home," Mr Harper said.
"He felt fine to drive. If he had waited 15 minutes, he might not have been over the limit."

Mr Harper said: “At some point, a day or so before, my client had taken cocaine.
"It is almost impossible to work out, after taking drugs, when you are going to be fit to drive.”
The solicitor said the drugs would have had no effect on his driving, and the drink would also "probably not" had much effect as he was close to the legal limit.
"He made a bad decision and went through a red light," Mr Harper said.
"There was damage to vehicles."

Trevor Burgess, chairman of the magistrates, told Jagielski he was receiving a 14-month driving ban for the drugs offence and a 12-month driving ban for the drink-drive offence. The two bans will run concurrently which means Jagielski will be banned for a total of 14 months.
Jagielski, of Colford Close, Droitwich, was also fined £1,000, and told to pay costs of £135 and victim surcharge of £100.
Jagielski offered to pay the total amount, £1,235, in full within 28 days, that offer accepted by magistrates.
The chairman warned the driving ban was immediate, and if he drives while disqualified if would risk going to jail.
A previous version of this story described Jagielski as receiving a 26-month ban. We have clarified this to show the two bans will run concurrently - 14 months in total.
