A DRUNK man who stole and crashed his girlfriend's BMW and assaulted her came close to being sent to prison.
Sam Clegg-McMahon ran off from the crash after police arrived leaving his girlfriend behind who was struggling to put weight on her foot.
The pair are now expecting a child with his girlfriend supporting him at court saying he was a very different character now.
Clegg-McMahon previously admitted using a motor vehicle on a road/public place without third party insurance, assaulting a person thereby occasioning them actual bodily harm, drink driving, taking the BMW without consent and possession of a class A drug.
Melanie Winterflood, prosecuting, said a 999 call was made reporting a car had crashed into a ditch on the B4084 near Cropthorne and the driver, Clegg-McMahon, had ran off.
An officer saw two people on the roadside - Clegg-McMahon and Megan Adams.
"As he approaches Mr Clegg-McMahon runs off," Miss Winterflood said.
"Miss Adams was in distress and struggling to put weight on her foot."
Clegg-McMahon was found by police a short distance away hiding in bushes, heavily intoxicated.
He had a white powder - later found to be cocaine - and the car keys.
Clegg-McMahon cried hysterically when he was arrested and told police he committed the crimes after having an argument with his partner.
He was double the drink drive limit with a test at the station showing he had 76 microgrammes of alcohol in 100 millilitres in his breath.
Miss Adams told police there had been an incident in which she had fractured her toe, but the prosecutor said the victim had later gone on to not support an assault prosecution.
Miss Winterflood explained Clegg-McMahon had admitted being guilty of assault on the reckless basis that he pushed his girlfriend, and in the fall she injured her foot.
Clegg-McMahon - who gave no fixed abode in court but had the recorded address of Berkeley Close, Whittington, Worcester - also has a previous conviction for possession of a controlled drug, magistrates heard.
Jason Patel, defending Clegg-McMahon, said his client was a drug addict and what happened had been an "isolated incident" but a "much-needed wake-up call" for him.
Mr Patel said Clegg-McMahon was supported in court by Miss Adams who is proud he is the father to her unborn child.
Magistrates also heard Clegg-McMahon had a child from a previous relationship, had taken steps to address his addiction, and wanted to get back into work as a bricklayer.

He was given 24 weeks in prison, suspended for two years.
Clegg-McMahon was ordered to complete the building better relationship programme and complete 20 rehabilitation activity days.
He was disqualified from driving for 20 months and fined a total of £480.
Clegg-McMahon was also told to pay £128 victim surcharge and costs of £185.
