A MAN who once ended up in court after drunkely wearing a cone on his head is still awaiting sentencing for harassment.
Daniel O'Donnell, of Park Avenue, Worcester, previously admitted at Worcester Magistrates Court to harassment in breach of a restraining order.
The breach had taken place on November 11 last year, after the restraining order had been imposed by the courts on April 13 that year.
O’Donnell had been given bail, but was taken into custody after admitting to breaching his bail conditions on March 10.
The case was listed in front of Judge Martin Jackson on Tuesday, (May 31), O’Donnell appearing via videolink from HMP Hewell.
Phil Brunt, prosecuting, explained there was due to be a Newton hearing to establish the facts on June 7. This type of hearing is needed when the two sides differ on something, with a judge tasked with ascertaining which party is telling the truth.
But Mr Brunt explained he was applying for that date to be vacated as O’Donnell is set to be interviewed by police on a related matter regarding the victim on June 6, which could mean he faces further charges.
Phil Thomas, defending, asked for the judge to order a date for when a charging decision should be made, following the interview.
But Mr Brunt said: “Your honour is not in possession of all the facts to make such an order.
“It is not the best way for your honour and the courts to keep an eye on this matter.”
He added that it could be a date was set in which the Crown Prosection Service were required to provide an update to the courts.

Judge Jackson said: “I’m slightly concerned we end up with things dragging along without a decision making in a reasonable time.
“It is concerning that there is at the moment a defendant is in custody awaiting sentence having pleaded guilty when the sentence could be affected very much by the outcome of investigations into further allegations.”
The judge vacated the Newton hearing date and said he was going to list the case for mention, adding he would want to hear on the progress on the investigation in that hearing.
The case was listed for mention on June 17.

Daniel “Dod” O’Donnell made national headlines in August 2016 after drinking on a night out in Worcester city centre before wearing the cone on head, leading to him being arrested and charged by police.
The former forklift operator was later handed a conditional discharge by Worcester magistrates for six months following the incident in Foregate Street in Worcester.
