AN agitated man wielded a machete and screamed 'I'll cut off your heads!' in Worcester because he believed someone was sleeping with his mum.
Thomas Allen kicked a door in Leckhampton Close in Worcester as he waved the large bladed weapon while accusing someone of sleeping with his mother. The defendant was later brought to the ground by armed police and arrested.
The 36-year-old of Cranham Drive, Warndon, Worcester admitted possession of the large knife when he appeared over videolink at Worcester Crown Court on Thursday.
John Brotherton, prosecuting, said the incident happened at 9pm on July 27 this year.
The defendant, previously a resident at St Paul's Hostel, was described as 'clearly agitated' when he kicked a door and withdrew a machete, 'shouting threats against people in the house' and suggested that one person had 'slept with his mother'.
"He was shouting he was going to cut people's heads off and cut people up" said Mr Brotherton.
The defendant was arrested by firearms officers and shouted: "I'm not going to lie to you - I'm willing to kill!"
Allen was taken to the ground and restrained by police.
Niall Skinner, defending, said "Someone had stolen his medication and that made him angry. He wanted his medication back. He accepts he went there and had the knife with him. He should not have done."
Mr Skinner said his client, who has been in custody, wanted to be released from prison so he could continue to make 'the strides' he had been making.
"He wants to try and get his life back on track" said Mr Skinner.
When the defendant listed the medication he was taking the judge, Recorder David Mason QC, described it as a 'proper medical chest'. Allen said he was not sure who had stolen his meds and added: "It just went wrong that night."
When Recorder Mason said he was minded to impose a two month prison term the prosecutor drew his attention to the section 28 minimum sentence for a second strike knife possession (six months in prison).
However, Recorder Mason said: "Bearing in mind the fact that Mr Allen is making very good progress on his community order imposed as long ago as February and doesn't expire until next February and the particular reasons why he managed to get himself involved with this, I think it's unjust to activate the minimum term in this case."
The judge said although Allen had a 'shocking record' the probation service appeared to be working with him to sort his life out.
We have previously reported how Allen, who has battled drug addiction, has both physical and mental health problems and is on a range of medications because of kidney failure.
Recorder Mason revoked the community sentence but Allen will remain in contact with the probation service via post sentence supervision which will run until October next year.
He added: "Please don't breach your licence. If you do it's going to get worse and worse for you. You're getting to an age where you need to go straight, don't you?"
The judge ordered the forfeiture and destruction of the machete. Because of time on remand, the sentence will mean Allen is released immediately.
"I for one don't want to see you back here again" said Recorder Mason.
The defendant replied: "Thank you. I understand."
