A PERSISTENT offender has been jailed for a month after hurling abuse at passers-by in the street while he was drunk.

Kevin Bayliss, of Elgar Avenue, Malvern, shouted racist abuse at a fast-food worker and told a woman to "show us your white knickers" after spending a morning drinking vodka.

Worcester magistrates heard how the 43-year old, who has 38 previous convictions, has been in and out of jail "like a shuttlecock". His latest appearance before the courts was for racially aggravated disorderly behaviour and breach of a criminal anti-social behaviour order (Crasbo) imposed on him on Thursday March 29.

Jo Barker, prosecuting, told the court: "On Thursday, March 29, at 4.30pm, a delivery driver for Domino's pizza in Malvern noticed an extremely intoxicated man sitting by the shop, shouting repeatedly at passers-by.

"Other witnesses identified the man as Kevin Bayliss.

"The Domino's worker came out after 30 minutes and told him to leave, and was sworn at and called a Paki'.

"The police were called to the scene, where they found the defendant under the influence of alcohol.

"After he was arrested, at the police interview he said he'd been drinking vodka since 9am that morning, and admitted breaching the Crasbo and the abuse."

Of the 38 previous offences Bayliss has, five of them are for Crasbo breaches since it was put in place in February.

He spent the whole of April in prison, as well as one week in May after two separate suspended sentences for previous offences were activated.

Mark Newton, defending, said: "Since the end of March he has had two custodial sentences imposed on him with immediate affect - he has been in and out of custody.

"Each times he goes into custody his benefits get suspended, so when he gets out he has to re-apply for them.

"It would be unjust to send him to custody for another short-term sentence - there is nothing in his record to show he is a racist; the witness accounts say he was very drunk on the day in question."

Magistrates decided to send Bayliss to prison for the next 28 days.
